Shield Recovery Inc. operates under California Repossession Agency Licence RA 1704, issued by the Bureau of Security and Investigative Services. Check the current state record at search.dca.ca.gov.

California requires a qualified manager to meet experience and examination requirements. Employees hired to recover property must be registered with the state; clerical employees and others who do not perform repossessions are exempt from that registration requirement. The rules Shield works under

Four things California requires. None of them are ours to waive.

Every line below is law rather than a Shield policy, and every line is linked to the statute or the regulator it comes from. You can check the whole of it without taking a word of this site on trust — which is roughly the standard a vendor file should be held to anyway.

  1. BPC 7500 et seq.

    The agency holds a state licence, and a qualified manager has met the state’s experience and examination requirements.

    Shield's number is RA 1704. It is searchable against the state register in about thirty seconds, and inviting you to do that is worth more than any assurance printed beside it.

  2. Com. Code 9609

    A secured party may take possession without a court order only if it proceeds without a breach of the peace.

    This is the rule the whole industry turns on, and the one a lender carries the exposure for. It has no checklist: what counts as a breach of the peace is decided afterwards, on the facts, which is why a recovery that should be stopped is worth more than one that is completed.

  3. BPC 7507.9

    Personal property found in a vehicle is inventoried, the debtor is notified, and the belongings are held for 60 days.

    The notice is generally due within 48 hours, with more time allowed in specified circumstances, and it must state how the belongings can be collected. The inventory itself is confidential: it is released to the debtor, to specified legal process, or to someone the debtor has authorised in writing — not to whoever asks, and that includes the lender.

  4. BSIS registration

    Employees hired to recover property are registered with the state.

    The requirement covers the people who perform repossessions. Clerical staff and others who do not are exempt from it — a distinction worth knowing before a questionnaire asks for a registration number for everyone at the company.

Insurance requirements

Share your institution's required coverages, limits and additional-insured requirements with operations. Confirm what documentation is available and whether the requirements can be met before approving an assignment.

Recovery has legal limits.

California Commercial Code section 9609 permits a secured party to take possession without judicial process only if it proceeds without breach of the peace. Questions about a particular recovery should be raised with operations and the assigning institution.
